These Terms and Conditions apply to all Goods and Services sold via our website. You can only purchase Goods from our website if you are eligible to enter into a contract and are at least 18 years old.

Interpretation

  • Consumer: An individual acting for purposes outside their trade, business, craft, or profession.
  • Contract: The legally binding agreement between you and us for the supply of Goods.
  • Delivery Location: The location where Goods are to be delivered, as set out in the Order.
  • Goods: The products advertised on our website that we supply to you as described in your Order.
  • Order: Your request for Goods from us as submitted via the website.

Goods

The description of the Goods is as set out on the website . Any images or description are for illustrative purposes only and there may be small discrepancies in the size and colour of the Goods supplied. Goods are subject to availability, and we may make changes necessary to comply with any applicable law or safety requirement.

If you register on the website, you must set up a username and password. You are responsible for all actions taken under your chosen username and password, and you must keep them confidential. We will handle your personal information in accordance with our Privacy Policy, and by using our website, you agree to be contacted by us via email or other electronic means.

Basis of Sale

The description of Goods on our website does not constitute a contractual offer to sell. When you place an Order, we can reject it for any reason. A Contract is formed only when you receive an Order Confirmation from us. You must ensure that the Order Confirmation is complete and accurate.

Price and Payment

The price of the Goods and any applicable delivery charges are as set out on the website at the time of your Order. Prices include VAT where applicable. Payment must be made using one of the accepted payment methods, including credit or debit card, Apple Pay, Google Pay, or any other methods we may introduce in the future. We may take payment at the time of Order or before delivery. For items available for pre-order, payment will be taken at the time the order is placed, and the goods will be dispatched by the advertised date where possible.

Delivery

We will deliver the Goods to the Delivery Location by the agreed time or, if no time is agreed, within 40 days. In the instance of pre-orders, we will deliver the items within 30 days of the advertised release date. If we fail to deliver on time, you can cancel the Contract and we will refund all payments made. In this instance, you must ensure that the Goods are returned to us in undamaged condition, and we will pay the return shipping costs.

Risk and Title

Risk of damage or loss passes to you when the Goods are delivered. You do not own the Goods until we have received full payment.

Withdrawal and Cancellation

You can cancel your Order before the Contract is made without liability. You may cancel the Contract within 14 days of delivery for any reason, except for certain non-returnable items (e.g., custom-made Goods). To cancel, you must inform us within 14 days and return the Goods in their original condition at your expense. We will refund the price of the Goods but may retain any delivery charges. This cancellation right does not apply to certain Goods, including perishable items and sealed products that have been unsealed.

Returns and Refunds

Our returns policy lasts 60 days. To be eligible for a return, the item must be unused, in the same condition as received, and in its original packaging. Certain items, such as gift cards and downloadable software, are non-returnable.

Once we receive and inspect the returned item, we will notify you of the approval or rejection of your refund. If approved, the refund for the goods will be processed and applied to your original payment method within 14 days. This will not include the cost of original shipping.

If your item is defective, damaged, or incorrect, we will replace it or refund your purchase. Sale items are non-refundable, except in cases of defects or damage.

Exchanges

We only replace items if they are defective or damaged. If you need to exchange an item, follow the returns process.

Gifts

If the item was marked as a gift, you will receive a gift credit for the value of the return. If the item wasn’t marked as a gift, the refund will be sent to the gift giver.

Shipping

You are responsible for paying the return shipping costs unless the return is due to our error.

Depending on your location, your order may be subject to customs fees, import duties, or other taxes levied by your local government. These charges are not covered by our company and must be paid by the customer at the time of delivery or as instructed by the relevant authorities.

Gift Card Terms & Conditions

Redemption

  • Gift cards can only be redeemed on [www.hammerfilms.com], our official webshop.
  • They may be used to purchase any product available on the site, unless otherwise stated.
  • Gift cards cannot be used to purchase additional gift cards.

Delivery

  • Virtual gift cards are delivered electronically via email to the address provided at checkout.
  • It is your responsibility to provide a valid and accurate email address.

Balance and Usage

  • Gift card balances can be used in full or in part across multiple transactions until the balance is zero.
  • If your purchase exceeds the gift card balance, you must pay the difference using another accepted payment method.

Refunds and Returns

  • Products purchased using a gift card are subject to our standard return and refund policies.
  • Refunds for returned items purchased with a gift card will be issued as a credit to the original gift card.

Limitations

  • Gift cards are non-transferable, non-refundable, and cannot be exchanged for cash.
  • No change or credit will be given for unused portions unless required by law.

Fraud Prevention

  • We reserve the right to cancel or refuse gift card redemption if fraud, misuse, or violation of these terms is suspected.

Conformity

We have a legal duty to supply Goods in conformity with the Contract. Upon delivery, the Goods will be of satisfactory quality, fit for purpose, and conform to their description.

Circumstances Beyond Our Control

If we fail to perform our obligations due to events beyond our reasonable control, our obligations will be suspended.

Excluding Liability
